Terms of Use

1. Parties and Acceptance

These Terms of Use ("Terms") are an agreement between Berk Demir ("dotAI", "we", "us") and you ("User", "you"), the person using the dotAI app ("App", "Service"). By downloading the App, tapping "Let's start" or using the App, you accept these Terms, including the Community Guidelines in Section 8, and confirm that you have read the Privacy Policy. If you do not accept them, do not use the App.

2. The Service

dotAI is an app that creates photos, videos and audio with artificial intelligence. You work with a crew of AI "agents", each with its own job (for example the Animator, Stylist, Camera, VFX, Sound and the Director, who runs ready-made, multi-step "Scenes"). You give an agent your photos and a description of what you want, choose a model and settings, see the price in credits and confirm. The work is done by AI models from fal.ai and its model partners, which we run for you through our servers.

Some features may be introduced gradually or only in certain versions of the App. A feature is part of the Service only once it is available in your App.

3. AI-Generated Content

Results are generated automatically by third-party AI models and may differ every time. AI output may be inaccurate, unexpected, of low quality, similar to other people's results or different from what you asked for, and a model may decline a request. Generation time depends on demand and on the provider. When a provider updates a model, we may move you to the new version; the App shows this, and the new price, before you confirm. We do not guarantee any particular result. For how your photos and prompts are sent to AI providers, see the Privacy Policy.

4. Eligibility and Age

You must be at least 13 years old to use the Service. If you are under 18, or under the age at which you can consent to digital services on your own in your country (16 in some EU countries), you may use dotAI only with the consent of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use of the App, including purchases. By using the App, you confirm that you meet these requirements.

5. Your Account

• Device account. The first time you open dotAI, a guest (device) account is created for you without an email address or password. It stays in place if you delete and reinstall the App on the same phone.
• Linking (optional). In Settings you can link your Apple or Google account. Without a linked account, neither you nor we can recover your account on a new phone or after the device is reset.
• You are responsible for the security of your device and of your linked accounts. Each account belongs to one person. Do not create new accounts to get around limits, prices or a suspension.
• Deleting your account. You can delete your account at any time in Settings › Delete account. Deletion takes effect immediately and cannot be undone; any remaining credits are deleted as well and are not refunded. Deleting your account does not cancel an App Store subscription (see Section 7).

6. Credits

• Credits are an in-app right to use dotAI, not money. They have no cash value and cannot be exchanged for money, sold or transferred to another person or account.
• Every job shows its price in credits before you confirm. Our servers set the price based on the model and settings you choose (such as length and resolution). Nothing is deducted until you confirm, and you pay the price that was shown when you confirmed. We may change the credit prices of models and Scenes in the future.
• Failed jobs. If a job fails on our side or at the AI provider, its credits are returned to your balance automatically. In a Scene, the failed step and the steps after it are refunded, and the parts already finished stay in your Library.
• Results you are not happy with. A completed result is not refunded automatically. You can report it to us with "Report a problem" on the result or by email; we review the report and may refund the credits (see Section 10).
• Credits do not expire while your account exists, including after a subscription ends.
• We may set reasonable usage limits to protect the Service.

7. Subscriptions and Credit Packs (dotAI Pro)

• All purchases are made through the Apple App Store and charged to your Apple Account. Current prices, periods and credit amounts are shown in your local currency on the purchase screen.
• Weekly subscription: a set number of credits is added at the start of each weekly period.
• Yearly subscription: billed once a year; credits are added monthly, at the start of each subscription month, for the year you paid for.
• Unused subscription credits carry over. There is no free trial unless the purchase screen clearly says so.
• Your subscription renews automatically unless it is canceled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription in your Apple Account settings (iPhone Settings › [your name] › Subscriptions) or in dotAI Settings with "Manage". Cancellation takes effect at the end of the current period; a yearly subscription keeps adding its monthly credits until the paid year ends. Deleting the App or your dotAI account does not cancel your subscription.
• Credit packs are one-time purchases and do not renew.
• Prices may change; a change does not affect a period you have already paid for.
• Subscriptions and purchases are processed through our purchase infrastructure providers (RevenueCat and, for older versions of the App, Adapty). Only your pseudonymous user ID and purchase data are shared with them.
• Refunds are handled under Apple's policies; you can request one at reportaproblem.apple.com. If Apple refunds a purchase, the credits it added are removed from your balance. If you have already spent them, your balance may go below zero, and you cannot start new paid jobs until it is positive again.
• To restore a purchase on a new device, use Settings › Restore purchases.
• Nothing in these Terms limits your mandatory rights under consumer protection law.

8. Acceptable Use and Community Guidelines

This section is dotAI's Community Guidelines. You may not use the App for any unlawful purpose. In particular, you may not use dotAI to create, upload or share:

• sexual content involving minors, or any sexualized depiction of a child (we report such content to the authorities);
• sexual or intimate content of a real person without that person's consent;
• deepfakes or impersonation intended to deceive, defraud, harass or damage someone's reputation;
• content that is unlawful, violent, threatening or hateful, or that infringes the rights of others (copyright, trademarks, privacy, personality rights).

You also may not reverse engineer the App; try to get around moderation, pricing, credit charges, limits or security measures; access the Service with bots or scripts; or abuse refunds, reports or purchases. Our AI providers' automated safety filters check inputs and outputs and may block a request.

9. Your Content

• Inputs. You keep all rights in the photos and text you provide. By uploading an input, you confirm that you own it or are allowed to use it, that every recognizable person in a photo is you or has agreed to this use, that you are the parent or guardian of anyone under 18 shown in the photo, and that the content is lawful.
• We process your inputs only to provide the Service to you (to create results, keep them in your Library, keep the Service safe and review reports), and we send them to our service providers for that purpose. fal.ai, which runs the AI models for us, does not use your inputs or results to train models; only anonymized or aggregated usage data may be used. Details are in the Privacy Policy.
• Results. To the extent permitted by law, your results belong to you, and you may use them for both personal and commercial purposes. The usage terms of the underlying model providers may also apply; where they do, we say so in the App. AI-generated content may not be protected by copyright in every country.
• You are responsible for having the necessary rights to the photos and content you upload and for how you use your results: do not use them in a way that infringes others' rights, misleads anyone or is otherwise unlawful. In particular, do not present an AI-generated image of a real person as real in a way that misleads or harms anyone.
• There is no public feed. Your work is not shown to other users unless you share it yourself (for example with the share sheet or by saving it to your photo library).

10. Reports and Moderation

• To tell us about a wrong, low-quality or inappropriate result, use "Report a problem" on the result, or email us. We review reports and let you know the outcome, including any credit refund.
• To report unlawful content or a violation of your rights (for example, your image being used without permission), write to support@dotaiapp.com.

11. Intellectual Property and License

The App, its design, crew characters (mascots), names, brand, logos and software belong to Berk Demir or his licensors, and all intellectual property rights are reserved. Subject to the App Store Usage Rules, you receive a personal, non-exclusive, non-transferable, limited and revocable license to use the App on Apple devices that you own or control. The App is licensed, not sold, to you. You may not copy, distribute, rent, sublicense or create derivative works of the App.

12. Limitation of Liability

The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law, dotAI is not liable for indirect, incidental or consequential damages, loss of profits or data arising from the use of the App, for the accuracy of AI output, or for content you create or share. This does not limit liability for intent, gross negligence or anything else that cannot be limited by law, and it does not affect your mandatory rights under consumer protection law.

13. Termination

You can end this agreement at any time by deleting your account. If you violate these Terms, we may block content, restrict features, or suspend or end your access, and where reasonable we will tell you why. If your account is closed because of a serious violation, remaining credits are not refunded unless the law requires otherwise. We may change or remove features, models and Scenes. If we shut down the Service entirely, we will announce it in the App a reasonable time in advance so that you can use your remaining credits; your mandatory legal rights are not affected.

14. Apple

These Terms are concluded between you and Berk Demir only, not with Apple. We alone, not Apple, are responsible for the App, its content, maintenance and support; Apple has no obligation to provide any maintenance or support services for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, claims arising under consumer protection or similar legislation, and claims that the App infringes a third party's intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms when using the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

15. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Nevşehir have jurisdiction over disputes. In consumer transactions, your right to apply to Consumer Arbitration Committees and Consumer Courts, and the mandatory consumer protections of your country of residence, remain reserved.

16. Changes

We may update these Terms and will announce significant changes in the App before they take effect. If you continue to use the App after a change, you accept the updated Terms. If you do not accept them, you can stop using the App and delete your account.
